TERMS AND CONDITIONS OF SALE
These terms and conditions govern the sales of products on the website www.duestelleitalia.it and regulate its use.
The Seller reserves the right to periodically modify these Terms and Conditions of Sale and the Privacy Policy, for example, following legislative or regulatory changes or changes to the functions of the Website. Such modifications will be communicated to Users via the Website with a specific notice for a period of 10 (ten) days from the date of the modification. The Customer is required to carefully read the Terms and Conditions made available on the Website to ensure their knowledge, as well as their storage and reproduction in accordance with Article 12, paragraph 3, of Legislative Decree 9 April 2003, No. 70. The contracts concluded with the Seller through the Website are governed by Italian law, particularly Legislative Decree 6 September 2005, No. 206 and subsequent amendments. Below are the Terms and Conditions of Sale applicable to any Product sold on the Website.
ART. 1 DEFINITIONS
For the purposes of this contract, the following definitions apply:
- Seller: Duestelle Italia by Eniko Juhaszova, with its registered office at Via La Fora 5 - 84081 Baronissi (VAT: 06106040659), email: duestelleitalia@gmail.com.
- Terms and Conditions or Contract: the set of these contractual clauses that determine and define the relationship between the Seller and the Customer.
- Platform or Website: the website www.duestelleitalia.it.
- Users: any person who accesses the Website and continues browsing.
- Customer: any person who purchases products sold through the Website.
- Consumer: a natural person acting for purposes unrelated to professional or entrepreneurial activities.
- Products: retail sales in the regime of E-commerce, mainly of jewelry and fashion accessories.
- Purchase Order or Order: the purchase proposal made by the User through the procedures of the Website, particularly via the Shopping Cart.
- Purchase: the paid acquisition of the above products from the day the purchase is completed.
- Shopping Cart: the phase of the purchase procedure where the User formulates their purchase proposal, selecting payment, delivery methods, and similar options.
ART. 2 OBJECT
These Terms and Conditions of Sale apply to the products mentioned in the following Article 3 and are valid between the Seller and any User who makes a purchase on the Website as a Consumer under the applicable regulations. If any of these conditions are found to be null or ineffective, the nullity or ineffectiveness does not extend to the remaining clauses of these terms and conditions.
ART. 3 PRODUCT DESCRIPTION
The Website handles retail sales in the regime of E-commerce, mainly of jewelry and fashion accessories.
Information about the Products, along with the respective product codes, is available on the Website, where the Customer can find detailed information about the main characteristics of individual Products. The Website may not contain all Products, representing only a selection of items typically available in partner stores.
All Products are subject to availability at the time of purchase. The Seller reserves the right to change the limits on the quantity and/or type of Products that can be purchased online on the Website at any time. The style, models, and colors of the Products described on the Website may be changed without notice. During the transaction process, an automatic response will inform the Customer of the time required to process the order and/or any inability to process the order due to the unavailability of the ordered Product. It will also be possible to purchase a line of customizable jewelry and accessories. All the products offered are described and illustrated on the Website, in their respective sections. The images of the Products on the Website are demonstrative and illustrative, represented as accurately as possible. However, there may be some errors, inaccuracies, or slight differences between the graphic/photographic representation of the Product and the actual Product. The photographs of the Products presented on the Website do not constitute a contractual element as they are merely symbolic representations of the Product being sold. Given this particular mode of sale, the User is informed that any discrepancies between the representations of the Products on the Website and the Products actually delivered can only be contested if they are significant.
ART. 4 PRICES AND ADDITIONAL COSTS
The prices of the Products are displayed in euros and include all applicable taxes or charges. Delivery costs, which are highlighted separately in the order form, must be added to the Product prices. The Seller constantly checks that all prices indicated on the Website are correct, although this does not guarantee the absence of errors. If a pricing error is found, the Seller will offer the Customer the option to reconfirm the order of the Products at the correct price or cancel it. Prices in the online store may be subject to change. In such cases, the prices published at the time of the Order in the online store are considered valid.
ART. 5 REGISTRATION
To make purchases on the Website, the User can register, entering their personal data and choosing the sales and service usage methods. The User who wishes to register on the Website must provide all requested data and is responsible for the truthfulness and accuracy of the data.
In the case of registration, the User guarantees the following when entering data:
- They are of legal age and legally capable;
- They meet the registration requirements requested at the time of registration;
- They will comply with all applicable legal and contractual norms related to these Terms and Conditions;
- They are the legitimate owner of the data entered, which is understood to be true, correct, and up-to-date.
Registration coincides with the opening of an account.
During registration, the User will be asked to provide a name, email, and password. The email address provided during registration allows the Seller to notify the User of all messages related to Services, Products, and the Website in general. It is forbidden to use temporary emails for registration. In cases of abuse, the Seller reserves the right to refuse registration, revoke it, and report it to the competent Authorities. All transmitted data will be treated with the utmost respect for privacy protection laws. The Seller will use this data to fulfill orders, and only if explicit consent is given, the data may also be used to provide information about its initiatives, such as news or promotional discounts.
ART. 6 PURCHASE PROCEDURE AND SALE CONCLUSION
The User can purchase all the Products offered for sale on the Website, as described in the respective information sheets, by following the purchase procedures provided on the Website. When purchasing the Products, the Customer must follow all instructions on the appropriate page of the Website. To purchase the Products, the Customer must complete and send the Seller the Purchase Order form in electronic format, following all instructions on the appropriate page of the Website. They will find a summary of the main commercial conditions, including the price, payment methods, and delivery options, along with information on the main characteristics of the ordered Products and a reference to the Terms and Conditions. The Customer must place the Product they wish to purchase in the appropriate "Cart" and, after reviewing the Terms and Conditions, particularly concerning delivery costs, the right of withdrawal, and the Privacy Policy, select the desired payment method and proceed with the payment. The applicable Terms and Conditions are those in effect at the time of the Order and can be found on the Website. The contract concluded between the Seller and the Customer is considered finalized upon acceptance of the Order by the Seller. The Seller's acceptance of the Order will be communicated to the Customer via an email sent to the provided email address. The Seller reserves the right to evaluate the acceptance of received orders and may refuse or not proceed with purchase orders that are incomplete or incorrect, or in the case of unavailable Products, or orders that involve delivering Products to certain disadvantaged geographic areas. The Seller will inform the Customer of the inability to accept received orders as soon as possible from the moment the Customer has transmitted the Order and will refund any amounts already paid by the Customer for the payment of the Products. The Customer has no right to compensation or indemnity, nor any contractual or extracontractual liability for direct or indirect damages to persons and/or property caused by the Seller's total or partial non-acceptance of an Order.
ART. 7 PAYMENT METHODS
The Customer can pay for the Products and related delivery costs via credit card and PayPal.
